The terms and conditions of Endorfin are outlined below:

 

Sauna & Ice-Bath Rules

 

• All persons using the sauna and ice-baths do so at their own risk. If you have any reservations regarding sauna and ice-bath use, such as medical conditions, underlying health problems, the use of prescription drugs or pregnancy, it is essential that you consult your GP before making a booking or using the sauna and ice-bath. If in any doubt, you should not use the sauna or ice-bath.

 

• All persons using the sea as a ‘cold plunge’ do so at their own risk. It is your own responsibility to ensure that you are a capable swimmer and can withstand cold temperatures and varying conditions of the sea.

 

• Limit your time in the ice-bath to less than 5 minutes. Slowly enter the ice-bath to give your body time to adapt to the cold temperature. Start by submerging your feet then gradually move your way up to your waist or shoulders. Practice slow deep breathing throughout the ice-bath to help regulate your body’s response to the cold. This can help minimise discomfort and maintain calmness.

 

• Remember while ice-baths can have the potential benefits such as reducing muscle soreness and inflammation they may not be suitable for everyone. It’s always best to listen to your body and discontinue use if you experience any adverse effects.

 

• Alcohol is not permitted in the sauna or ice-bath. Endorfin operators reserve the right to refuse admission to intoxicated persons or for other reasons may be deemed a health and safety risk. Refunds will not be offered to anyone refused admission.

 

• Jewellery should be removed before entering the sauna to prevent burning. Please ensure your swimwear does not contain any metal parts which may heat up and possibly burn the skin.

 

• Nudity is not permitted in the sauna or ice-bath. Swimwear must be worn at all times.

 

• Large buckets will be provided to store personal belongings during your sauna session, however all persons do so at their own risk. Endorfin operators accepts no responsibility or liability for missing, lost, or stolen possessions.

 

• If you are making this booking on behalf of a group, it is your responsibility to make all users aware of what to bring and other useful information.

 

• Anyone under the age of 16 are not permitted to use the sauna or ice-bath for safety reasons.

 

 

Sauna etiquette must be adhered to at all times. This includes:

 

• Spending no more than 15 minutes in the sauna at any one times. Leave the sauna immediately if you begin to feel dizzy, nauseous, or lightheaded. Use the sand-timer provided inside the sauna to keep track of how much time you have spent in each session.

 

• Following operators’ instruction on how to pour water onto the hot rocks. Use the ladle provided to ensure that your arm is at a safe distance from the stove. Only pour the ‘sauna water’ which is provided in the bucket inside the sauna on the hot rocks and nothing else. This should only be done intermittently to ensure the temperature does not increase rapidly and only when all sauna users are seated.

 

• Entering and exiting the Sauna safely. Move slowly and give other sauna users space to move, the sauna is accessed via steps and the floor inside can become slippery at times.

 

• Never touch the stove or open the stove door. Only trained members of staff are permitted to operate the stove and will be available at all times for any queries. Do not hang towels or clothes to dry in the sauna, as this may cause a risk of fire.

 

• Respect other sauna users. Check with other sauna users before pouring water on the rocks as this will produce steam and increase the heat in the sauna.

 

• Hydration – Drink plenty of water before entering the sauna and after existing the sauna.

 

• Bring a clean towel to sit on inside the sauna. This is for the hygiene of yourself and other sauna users.

 

• Avoid using creams on your skin prior to using the sauna. They can clog up your pores and prevent your skin from breathing and sweating efficiently.

 

• Take time to cool down after your sauna in the open air or water (sea or ice-bath). Alternate between the hot and cold therapy to get the most out of your sauna experience. All persons using the sea or ice-bath as a ‘cold plunge’ do so at your own risk.

 

• It is recommended to rest for at least ten minutes after finishing your sauna session. This will give your body some time to rebalance and for your heart rate to slow down.

 

There is a trained operator of Endorfin available at all times for any queries and support during your sauna session. If anything is wrong, please inform us immediately

 

Rescheduling and Cancellation Policy

 

To cancel or reschedule your booking, please email us your booking details with cancellation in the email subject line to hello@endorfin.ie. To obtain a refund or credit for any of our experiences, you must give adequate notice as detailed below.

 

• Refund: Minimum 3 day’s notice required to cancel your experience and obtain a refund of the experience cost. Please note that Stripe’s processing fee from the original transaction will not be refunded.

 

• Reschedule: Minimum 24 hour’s notice to reschedule your experience to another date/time. Please sign up (using the email you booked with) or log in and go to “change/cancel appointment” to reschedule. You cannot reschedule your appointment within 24 hours.

 

We regret that we do not offer refunds or credit if it’s less than 48 hrs notice. We do not refund ‘no shows’. If due to unforeseeable circumstances we need to cancel your experience, you will be notified by email and will receive a full refund or credit. We reserve the right to make changes to the schedule at short notice.

 

 

Privacy Policy

 

This privacy policy explains how Endorfin will process your data relating to you that you provide to us, or that we may collect when you visit our website at www.endorfin.ie (website).

 

We are committed to protecting the personal data that we obtain. The privacy and confidentiality of our clients and visitors to our website matter to us. We will deal with your personal data in compliance with all current applicable data protection laws.

 

Our website may contain hyperlinks to third party websites. These third-party websites operate independently from us, and we cannot accept any responsibility or liability for the privacy practices of such third parties nor the availability of these external sites or resources. The appearance of such links on our website is not an endorsement. Should you use any of these websites, such use is at your own risk, and we would advise that you review their respective privacy policies.

 

Our website is hosted by Hostinger and we use the services of Stripe that allows us to accept payments online via our website and Instagram for the services we provide to you.  Payment: if you choose a direct payment gateway to complete your purchase via our website or Instagram then Stripe will store your payment data. It is encrypted through Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your transaction. After that your purchase transaction information is deleted. Stripe does not share your payment details with us other than transaction amount and reference number and your contact details as required to identify you for your booking purposes. We will only contact you via email if you have opted into our emails or in relation to your order. Please refer to the respective websites of Hostinger and Stripe for further details of their Terms of Service or Privacy Statement.

 

How we collect your data?

 

• Contact Form – When you complete a contact form, we collect your name, phone number and email, and any further information you choose to provide in your message.
• Telephone Data – We will only collect personal information that you consent to provide to us in order to deliver a service.
• Email Data that you provide – When you contact us via email, we will retain your email and our response to it for as long as the business issue remains and there is legitimate interest. We store this data for five years after your last interaction with us unless you withdraw consent.
• Face to Face Contact – If you provided your contact details to us face to face, we may contact you via email or telephone. The legal basis for this is legitimate interest. We store this data for five years after your last interaction with us unless you withdraw consent.
• Cookies & Analytics – Our website does not use cookies. Our website uses website analytics, including Goggle Analytics, to evaluate and improve our website, personalise your experience and to offer the best, most accessible service possible to all of our clients.

 

Existing customers

If you are already a customer of Endorfin, we will hold your data under the legal basis of legitimate interest and may send you marketing materials, unless you opt out of emails.

 

Marketing

Where we provide you with information about our services or offers (via our newsletters), or if we contact you for market research purposes (such as surveys and feedback requests), we will only use your personal information in this way in accordance with laws relating to marketing directly to individuals, and in the pursuit of our legitimate interest of marketing our business.

Your rights in relation to the personal data that we process

You have the following rights over the way we process personal data relating to you. We aim to comply without undue delay, and within one month at the latest:

 

• To ask for a copy of data we are processing about you and have inaccuracies corrected.
• To ask us to restrict, stop processing, or to delete your personal data.
• To request a machine-readable copy of your personal data, which you can use with another service provider. Where it is technically feasible, you can ask us to send this information directly to another provider if you prefer; and

Assumption of Risk and Liability Waiver

In consideration of being permitted to use Endorfin Sauna and Ice-bath facilities, located at any location whereby this sauna operates, you the user hereby execute this Assumption of Risk and Liability Waiver Form (the ‘Waiver’) upon making your appointment either online or in person. The Waiver covers the entirety of your period of use of the Sauna pursuant to the associated booking agreement with Endorfin (the ‘Owner’).

 

For the purpose of this Waiver the “Owner Related Parties” refers to the owner’s management, employees, subcontractors, agents and representatives, volunteers, sponsors, insurance carrier or equipment suppliers.

 

This Waiver relates to use of the “Sauna” being the allotted time use period and other related facilities including without limitation, the pathways, entrances to including steps and ice-baths situated within the immediate vicinity of the Sauna and does not relate to any space outside of the immediate vicinity of the Sauna facilities as cordoned off.

 

As a “Sauna User” you are electing to use the Sauna and Ice-baths of your own free will and confirm that your decision to use the Sauna and Ice-baths and to execute this Waiver is entirely voluntary. You assume full responsibility for all risks that may arise out of or result from directly or indirectly, the use of the Sauna and Ice-baths, but not limited to the risks described in these Terms & Conditions.

 

Risk Factors

I understand and acknowledge that my use of the Sauna and ice-baths involves risk including, but not limited to the risk of property damage, bodily injury and possibly death.

These risks may result from a variety of circumstances including, but not limited to:

 

• Use or misuse of the sauna and ice-baths.
• Actions of myself and/or others, including without limitation actions of the Owners or any Owner Related Party.
• Lack of supervision of the Sauna and Ice-baths by trained personnel or otherwise.
• Unavailability of emergency care.

 

Acknowledgement of Sauna Rules & Regulations

I acknowledge, warrant, and confirm as follows:

 

• The inside of the Sauna is not supervised by the Owners, its employees or by any Owner related parties.
• I have read and agree to comply with all the Sauna and Ice-bath Rules & Regulations and understand that the safe and proper use of the Sauna and Ice-bath is dependent upon strict compliance with the Sauna and ice-bath Rules & Regulations.
• I have no health problems whatsoever which preclude me from using the Sauna and Ice-bath.
• I have the requisite skill, qualification, physical ability and training necessary to properly and safety use the Sauna and Ice-bath, should I have any questions as what skill, qualification, or training necessary to properly and safely use the sauna and Ice-bath, then I shall direct such questions to my GP and/or the appropriate individuals.
• I understand that the Owners reserve the right to revoke or terminate my authorisation to use the Sauna for any violation of this Waiver, or the Sauna Rules & Regulations

 

Assumption of Risk

 

I am electing to use the Sauna and Ice-baths of my own free will and confirm that my decision to use the Sauna and Ice-baths and to execute this Waiver is entirely voluntary. I assume full responsibility for all risks that may arise out of or result from, directly or indirectly, my use of the Sauna and Ice-baths including, but not limited to the risks described in the section ‘Sauna Rules’. Excepted from this section are any injuries caused by the negligence or wilful misconduct of the owner or any Owner Related Party.

 

Payment

I agree to pay for any and all damages to any property belonging to the Owners or any Owner Related Party caused by me negligently, wilfully or otherwise.

 

Insurance

I understand that I am solely responsible for any medical, health or personal injury costs relating to my use of the Sauna and Ice-Baths. I understand that I am strongly encouraged to have a medical examination prior to the use of the Sauna and Ice-baths.

 

Jurisdiction

This Waiver and any disputes arising therefrom shall be governed by the laws of Ireland.

 

Release Waiver and Indemnity

I, my spouse (if any), heirs, executors, administrators and assigns, hereby release, waive, discharge hold harmless covenant not to sue the Owners nor any of the Owners related parties for any and all claims, liabilities, judgements, costs and expenses related to such claims, for any property damage, property loss or theft, personal injury or illness, death or other loss arising from or relating to my use of the Sauna and Ice-Baths, I also agree to defend, indemnify and hold harmless the Owners and Owners related Parties from and against any claims, including without limitation, claims made by other Sauna and Ice-Bath users, employees, rescuers or any other person, arising from or related to my own acts or omissions in connection with my use of the Sauna and Ice-baths.

 

Severability

If any provision or part-time provision of this Waiver is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provisions or part-time provision shall be deemed deleted. It is the express intention of the parties that any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this waiver.

 

Merger

This waiver together with the terms of the Sauna and ice-bath Rules and Regulations as provided to the Sauna User set forth the entire agreement between the parties with respect to the use of the Sauna and ice-baths. There have been no additional oral or written representations or agreements of or with Owners or any Owner related Party on which I have relied in entering into this Assumption and Waiver.

 

By making an appointment and using the Sauna and Ice-Baths you confirm that you have read and fully understand the Sauna and Ice-bath Rules and Regulations, and this Waiver and understand that it relates to the surrendering and releasing of my legal rights. Upon such you agree to this Waiver freely and voluntarily, with the full intent of releasing the Owners and Owner related Parties from liability for injury or loss due to the inherent risks of my use of the Sauna and Ice-bath.

 

Changes of this Policy

This waiver may be updated from time to time. We will notify you of any changes to our waiver by posting any updates to our Instagram account. You are advised to consult this privacy policy regularly for any changes.
